If a person is arrested by the police, he or she is to be under physical restraint for up to 72 hours by the police and the prosecutor. The public prosecutor may request the judge for an extension of the period for physical restraint (or detention) on the ground of the necessity for investigation, and the period for his/her physical restraint may, if approved, be extended for additional 10 days. If the prosecutor sees the necessity of further investigation and request the judge for the further extension of the detention period, it may last for up to 23 days. During that period, the suspect is unable to get home, go to the office or contact his/her family freely (except in case of some significant incidents).
During such detention period, the prosecutor will determine whether or not to bring charges against the suspect. In other words, what and how the suspect’s family do through his/her lawyer during that period will have a critical impact on the prosecutor’s decision.
Verybest works on the court and to the prosecutor to gain the client’s early release and not to extend the detention, aiming at the earliest release of him/her from detention, and acts as a counsel for the client including communications with the victim. We provide prompt and appropriate legal advice even within a limited amount of time. We are a powerful supporter for persons arrested or detained.
